Insurer Good Faith Requirements
A Maryland consumer who has a property and casualty insurance policy (property and casualty insurance includes automobile, homeowners, fire and/or dwelling, inland marine, commercial liability policies) that was issued, sold or delivered in Maryland and believes that his/her property and casualty insurer failed to act in good faith in making a decision regarding his/her first-party insurance claim may seek special damages against the insurer by filing a civil complaint, in addition to or in place of filing an administrative consumer complaint with the Maryland Insurance Administration (MIA).
Case Decisions (27-1001)
In July 2008, the MIA began to issue written opinions in 27-1001 cases regarding questions of good faith on the part of property and casualty insurers in first party claims. Cases are listed in sequential order and missing numbers represent those cases that were withdrawn, settled or not within the jurisdiction of 27-1001. For other information regarding these cases, please call or file a request for documents under the Maryland Public Information Act. Refer to other administrative actions by this agency under Orders.
